Terms of Service

These Terms explain how to use FreeImage.top responsibly and what both you and we can expect from the Service.

1. Scope and Acceptance

These Terms of Service ("Terms") apply when you access or use FreeImage.top (the "Service").

By using the Service, you agree to these Terms. If you do not agree, please stop using the Service.

2. Eligibility and Compliance

You must be legally able to enter into a binding agreement under applicable law to use the Service.

You are responsible for making sure your use of the Service complies with laws, regulations, and third-party rights in your jurisdiction.

3. Service Description and Availability

FreeImage.top provides AI image generation based on your prompts. Features, output quality, model providers, limits, and availability may change over time.

We may add, modify, suspend, or discontinue parts of the Service when reasonably necessary for product, legal, security, or operational reasons.

4. Acceptable Use

We want this platform to stay useful and safe for everyone. You agree to use the Service lawfully and responsibly.

The restrictions below are core conditions for access:

4.1 Lawful and Safe Use

  • Do not generate, request, or distribute content that is illegal, fraudulent, threatening, harassing, hateful, defamatory, or otherwise unlawful.
  • Do not create or promote content involving sexual exploitation, child endangerment, trafficking, terrorism, or instructions for violent wrongdoing.
  • Do not use the Service to create malware-related assets, phishing materials, or deceptive content intended to harm others.

4.2 Real Persons, Identity, and Privacy

  • Do not generate or distribute images of identifiable real people where consent, authorization, or another lawful basis is required.
  • Do not create deceptive impersonation, deepfakes, or false-endorsement content that misleads others about identity, affiliation, or events.
  • Do not expose personal data, private images, or sensitive information without legal permission.

4.3 Intellectual Property and Brand Rights

  • Do not use the Service in ways that infringe copyright, trademark, publicity, privacy, or other proprietary rights.
  • Do not remove ownership notices or claim exclusive ownership of material you do not have rights to use.
  • Do not use generated content to misrepresent third-party brands, products, or official communications.

4.4 Security, Abuse, and Platform Integrity

  • Do not reverse engineer, probe, scan, or attempt unauthorized access to the Service, models, infrastructure, or related systems.
  • Do not bypass or attempt to bypass safety features, usage limits, traffic controls, anti-bot systems, or technical restrictions.
  • Do not use scripts, automation, or bulk workflows to extract outputs at scale without our prior written authorization.

4.5 Commercial Boundary

  • You may generally use generated images for personal and business projects, subject to law and these Terms.
  • You may not resell, white-label, or provide access to the Service itself as a hosted product, API, or competing generation platform without our written permission.
  • Do not use the Service in ways that create abnormal infrastructure load or reduce fair access for other users.

4.6 High-Risk Use Restriction

  • Do not rely on the Service as the sole basis for medical, legal, compliance, biometric, law-enforcement, or other high-risk decisions.
  • You are responsible for human review and independent validation before using output in consequential real-world contexts.

5. Monitoring, Moderation, and Enforcement

To protect users and the platform, we may monitor relevant usage signals, apply automated or manual review, and enforce these Terms.

  • Reject or block prompts and outputs.
  • Apply rate limits, temporary restrictions, or permanent bans.
  • Remove or disable access to content or features.
  • Retain relevant technical logs for abuse investigation, security, and legal compliance.
  • Report unlawful conduct to appropriate authorities when required or reasonably necessary.

6. User Input and License to Operate

You keep any rights you may have in prompts or other material you submit ("Input").

You grant us and our subprocessors a non-exclusive, worldwide, royalty-free license to host, transmit, process, and transform Input as needed to run, secure, and improve the Service.

This license is limited to Service-related purposes and lasts only as long as reasonably needed for those purposes.

7. Generated Output and Responsibility

Subject to these Terms, you may generally use generated output ("Output") for personal and commercial projects.

Output may be similar or identical to content generated for other users, so we do not guarantee uniqueness, originality, or non-infringement.

You are responsible for reviewing and clearing Output before publishing, sharing, or commercial use.

8. Third-Party Providers

The Service may rely on third-party infrastructure, model providers, and security services.

Those underlying services may have their own terms, limitations, and compliance requirements.

9. Data Retention and No Recovery Guarantee

As noted on our product pages, prompts and generated images are not stored for account-based history retrieval.

Operational and security logs may be retained for a limited period when reasonably necessary for abuse prevention, reliability, and compliance.

Please download and back up any Output you want to keep, because recovery is not guaranteed.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind (express, implied, statutory, or otherwise).

To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

11. Limitation of Liability

To the fullest extent allowed by law, FreeImage.top and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.

Our total liability for claims related to the Service is limited to the greater of USD 100 or the amount you paid us for the Service in the 12 months before the claim (if any).

12. Indemnification

You agree to defend, indemnify, and hold harmless FreeImage.top and its operators from claims, liabilities, damages, losses, and expenses arising from your Input, your use of Output, your violation of these Terms, or your violation of law or third-party rights.

13. Suspension and Termination

We may suspend or terminate access immediately, with or without notice, if we reasonably believe you violated these Terms, created legal or security risk, or engaged in abusive behavior.

Terms that should survive by nature (including disclaimers, liability limits, indemnities, and dispute-related provisions) remain in effect after termination.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted unless a later date is stated.

If you continue using the Service after the effective date, you accept the updated Terms.

15. Governing Law and Disputes

To the extent permitted by applicable law, these Terms are governed by the laws applicable to the operator's principal place of business, without regard to conflict-of-law principles.

Before starting formal legal proceedings, you agree to first try to resolve disputes with us in good faith.
